RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

 

By signing this document, you will waive certain legal rights, including the right to sue.

Please read carefully.

 

 

1. AWARENESS AND ASSUMPTION OF RISK

I am aware that participating in a remote retreat organized by Oona Adventures Ltd. involves inherent risks, dangers, and hazards, which may result in personal injury, illness, death, property damage, or financial loss.

 

These risks include, but are not limited to:

 

• Walking and hiking on uneven, steep, slippery, or poorly maintained terrain;

• Walking on roads without sidewalks and exposure to vehicle traffic;

• Travel to and from the retreat location, including embarking and disembarking from boats and exposure to water-related hazards;

• Use of retreat facilities that may present risks of slips, falls, fire, structural or other hazards;

• Participation in arts and crafts activities, including the use of tools and materials that may cause injury;

• Consumption of food and beverages prepared by staff, including the risk of allergic reactions, foodborne illness, contamination, or dietary issues;

• Exposure to wildlife, insects, and environmental conditions;

• Remote location risks, including limited or delayed access to medical care and emergency services, including reliance on air evacuation.

 

I understand that injuries or illness may occur and that medical assistance may be delayed or limited. I acknowledge that, in the event of a serious injury or illness, emergency transport such as air ambulance may be required at my own risk and potential expense.

 

I further understand that these risks may arise from foreseeable or unforeseeable causes, including negligence on the part of Oona Adventures Ltd., its directors, officers, employees, contractors, landowners, agents, and representatives (collectively, the “Releasees”).

 

I voluntarily accept and fully assume all such risks and all responsibility for any resulting loss, injury, damage, or expense, including death.

 

2. TRAVEL, WEATHER, AND SCHEDULING RISKS

I acknowledge that access to and from the retreat location is weather-dependent and subject to transportation availability, including marine or air travel.

I understand and accept that:

• Travel to or from the retreat may be delayed, rescheduled, or cancelled due to weather, mechanical issues, or other factors beyond the control of Oona Adventures Ltd.;

• I may be required to arrive later than planned or remain at the retreat location longer than expected;

• Such delays or changes may result in inconvenience, additional personal expenses, or financial losses, including but not limited to missed work, missed travel connections, or other opportunity costs.

I expressly assume all risks and costs associated with such delays or disruptions.

I agree that Oona Adventures Ltd. and Releasees shall not be liable for any loss, damage, expense, or inconvenience arising from travel delays, extended stays, or inability to access or depart from the retreat location, including any indirect or consequential losses such as loss of income or business opportunities.

I have specifically read and understood this section regarding travel delays, weather dependency, and the possibility of extended stays.

3. RELEASE OF LIABILITY AND WAIVER OF CLAIMS

In consideration of Oona Adventures Ltd. accepting my application to participate in this activity, I agree:

• To waive any and all claims that I have or may in the future have against Oona Adventures Ltd. and Releasees.

• To release Oona Adventures Ltd. and Releasees from any and all liability for any loss, damage, injury, expense or death that I may suffer as a result of my participation in the retreat, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory duty of care. I specifically acknowledge that this release includes claims based on negligence.

4. INDEMNITY

I agree to hold harmless and indemnify Oona Adventures Ltd. and Releasees from and against any and all claims, demands, damages, costs (including legal fees on a solicitor-client basis), or liabilities arising from:

• My participation in the retreat;

• My actions or conduct while participating in the retreat;

• Any breach of this agreement.

This indemnification shall be binding on my heirs, next of kin, executors, administrators, and shall survive the completion or termination of the retreat.

 

5. MEDICAL AND HEALTH ACKNOWLEDGMENT

I confirm that:

• I am physically and mentally capable of participating in retreat activities;

• I have disclosed any relevant medical conditions, allergies, or dietary restrictions;

• I understand that I am responsible for my own medical care and insurance coverage;

• I understand that emergency medical treatment and evacuation (including by air) may be required and may be delayed, and I agree to bear any associated costs.

6. ACKNOWLEDGMENT, UNDERSTANDING, AND NO RELIANCE

I confirm that:

• I have read and fully understand this agreement;

• I understand that by signing this document I am waiving certain legal rights, including the right to sue;

• I have been given the opportunity to ask questions and seek independent legal advice;

• I am signing this agreement voluntarily and without reliance on any representations not contained in this document;

• This agreement is binding on myself and my heirs, next of kin, executors, administrators, and assigns;

• In signing this document and participating in the activities, I do not rely upon any oral or written statements, promises, or other communications made by Oona Adventures Ltd., except as set out in this agreement.

 

7. SEVERABILITY

If any provision of this agreement is found to be unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect.

 

8. GOVERNING LAW

This document will be exclusively governed by and interpreted in accordance with the law of British Columbia and no court outside British Columbia will have any jurisdiction over this agreement, the activities, or any other matter arising from them.
